1. Terms Of Use

Through the access, viewing, download and/or submission of any content or material on or related to the services provided, you agree to these Terms and Conditions of use, as they pertain to a legally binding agreement between any User and National Obituary Registry without limitation. The term "User" refers throughout these Terms and Conditions to anyone who accesses, views, downloads and/or submits any content or material on or related to the "Services" provided by National Obituary Registry. The term "Services" refers to any content, link, transaction, record or information that is viewed, posted, searched or used by the "User", as that term is defined under these terms and conditions. If you do not agree with these Terms of Use, then you may not use the Services provided by National Obituary Registry. By agreeing with these Terms of Use, you agree that each and every time you access National Obituary Registry or use the Services, you will be subject to the then-current Terms of Use.

2. User Conduct

By agreeing to the Terms of Use you agree that your use of the Services is subject to any and every applicable local, state, provincial, national and international laws and regulations. You also agree to not use the Services for illegal purposes, use the Services for any commercial activities or purpose and not to host, submit content or use the Services without the consent of a parent, guardian or educational supervisor if you are under the age of 13 or are considered a minor. In addition, you are forbidden from copying any content, including death notices, for republication in any other newspaper, publication or content resource, whether print or on-line. Each and every User is also forbidden from creating or maintaining content in connection with the Services for or with any commercial purpose or to benefit any party other than National Obituary Registry including but not limited to the purchase, acquisition, designation or choice of a website name, title, address or URL for commercial purpose, depriving any family member or friend of a deceased person from establishing or using the Services in the name of the deceased and linking to any website without the expressed permission of National Obituary Registry.

No User may attempt to gain unauthorized access to other computer systems through our website, use the Services for chain letters, junk mail, spamming or the distribution of any content not prescribed through the Terms of Use. In conclusion, any User is forbidden from uploading, transmitting or posting any harmful material that is either illegal, harmful, disruptive or relating to destructive files. Agreeance to both the Terms of Use and User Conduct prevents you from interfering in any way, disrupt or otherwise harm or violate the security of the Services, any User account or passwords, National Obituary Registry's servers or networks connected to, extending but not limited to our partner newspapers, funeral homes and any other organization partnered with National Obituary Registry.

3. Content

Due to the nature of the Services that allow content to be posted, uploaded, transmitted, displayed, published and distributed, including but not limited to comments, information, images, videos, lyrics, illustrations, articles, audio files, poems and any other forms of multimedia content, any User is forbidden from submitting any material that is profane, abusive, sexually explicit, hateful, defamatory, threatening, false misleading or fraudulent in nature. Additionally, all attacks on any User or person that are sexual, racial, biased, hateful or could otherwise be generally considered to be in poor taste are absolutely prohibited by National Obituary Registry. All users are there in by restricted from unfairly interfering with any third-party's uninterrupted enjoyment of the Services or disclosing any information that can be considered to be personal identifying information relating to any other User. No User, extending to the content involved with their use of the Services, can infringe on any copyright, trademark, patent, trade secret or any other intellectual property relating to the Use of National Obituary Registry.

No user is permitted to submit any material that is harmful to or inappropriate for minors to view, discloses any information relating to or any multimedia content containing a minor without consent of a parent guardian or educational supervisor, including but limited to death notices, comments or any other form of content as it pertains to National Obituary Registry and the Terms of Use. By agreeing to these terms you acknowledge that National Obituary Registry does not control and is not responsible for user-generated content or any material submitted to the Services. In addition, National Obituary Registry does not support, confirm or endorse that any information found in or provided by the Services is accurate, up to date, complete or in compliance with the most current Terms of Use.

National Obituary Registry reserves the right, without obligation, responsibility or duty to, review, refuse to post, edit or remove entirely any content or material that contradicts or infringes upon the Terms of Use. National Obituary Registry also reserves the right to remove or edit any content or material available through or submitted to the Services without any reason whatsoever, in its absolute and sole discretion. Under the Terms of Use, you also agree and acknowledge that the Services and content provided through the Services may contain proprietary information that is protected by intellectual property laws and any pertinent law or regulations and may not be used except as stipulated by the most current Terms of Use.

4. Modification To Services

National Obituary Registry reserves the right, in its sole discretion and without limitation, to suspend, modify, discontinue, or withhold entirely at anytime, with or without notice, any services as outlined in the Terms of Use. This extends but is not limited to access through National Obituary Registry to any content, material or submissions by third-party partners or authorized users as defined in the most current Terms of Use.

5. Liability

In no event and at no time shall National Obituary Registry be liable for any incidental or consequential damages, or any loss whatsoever, either indirect or direct, resulting from any action, negligence, in connection with the Use, the Services, inability to use and performance of those Services as outlined in the Terms of Use. In addition, National Obituary Registry is not responsible or liable for any damages that may occur on any device or equipment used to access, upload, view, post or Use the content, material, website of either National Obituary Registry or any third-party partner. National Obituary Registry assumes no responsibility or liability for the damage caused, either directly or indirectly, by any information, content, material or transmission that is slanderous, libel, fraudulent, dated, false or misleading.

6. Commissions & Profit Sharing

Any User who by definition is a funeral home, association or supporting third-party organization designated as a registrant or partner by ObitTree Inc. is eligible to receive commissions through the profit sharing structure of the National Obituary Registry. The profit sharing structure can fluctuate at any time and National Obituary Registry reserves the right to withhold any commissions, while the beneficiary is identified, cleared, verified or within reasonable discretion. As such, no standard rates apply to the commission structure for which eligible Users are entitled, through their registration, to participate.

All commissions received, paid or distributed by ObitTree Inc. can be used as credit toward a variety of purposes, including but not limited to technology costs, association membership fees, donations and cash withdrawals. ObitTree Inc. reserves the right to update, remove or modify any of these options, at any time. Eligible Users are responsible for monitoring his or her own account balance, credit history, commissions or any other administrative duties pertaining to their registration, herein, with the National Obituary Registry, ObitTree Inc.

7. Account Termination & Cancellation

Any User, as defined by the Terms of Use, may cancel an account, change and/or terminate their password, account and/or use of the Service, with or without cause, at any time upon providing written notice, either in print or online, effective immediately. Upon termination of an account, the privileges of Use and subscription to the Service are immediately revoked and any ability to Use immediately ceases. In turn, National Obituary Registry assumes the right to at anytime, with or without reason, to suspend, cancel, transfer or terminate any account, any User and/or use of any Services or access to the Service. Upon termination or expiration of an account, any further access to any content or materials submitted or accessed by the User. These Terms of Use apply to any User, account or third-party that includes but is not limited to memorial websites, Newspapers, individuals, groups, businesses, organizations, sponsors or hosts.

8. Account Password & Security

Use of National Obituary Registry and any Services therein, as outlined under the Terms of Use, may require a password and personal information that is considered to be confidential. Any User is responsible for the security of this password and in turn, the overall security of the personal information supplied to National Obituary Registry by that User. National Obituary Registry is not responsible or liable for any loss or damage incurred by any User or account that has been compromised by failure to secure any password, personal information or compromising account information resulting in such damage.

9. Links

National Obituary Registry offers opportunities for third-party companies, partners, Newspapers, organizations, funeral homes and individuals to link to other website if and only when those links comply with the current Terms of Use. National Obituary Registry has no control, and assumes no responsibility for any third-party website pages, content or any experience resulting from use of those websites. Any commercial reference, advertisement or marketing content accessed through any third-party website is not endorsed by National Obituary Registry, unless expressed otherwise.

10. Trademarks and are registered trademarks of National Obituary Registry. These trademarks, logos, names, used on or in connection with the Services may not be used in any connection with any commercial product or service that is not under National Obituary Registry's ownership or control. In addition, such trademarks may not be used in any manner without the expressed written consent of National Obituary Registry.

11. Third-party Software

If a User chooses to download, access, view or submit content or material to any third-party software that National Obituary Registry makes available in connection, either directly or indirectly, with the Services, that User may have to agree to the terms and conditions administered by that third-party provider, partner or affiliated firm. If you choose not to agree with the terms of such software, then do not download the software.

12. General

These Terms of Use predicate the conduct, responsibility and liability of User or Users as it relates to the Services, trademarks and Use of National Obituary Registry and any affiliated third-party company, newspaper, website or individual. By extension, the language in these Terms of Use shall be interpreted in accordance with fair meaning and shall not be explicitly or strictly interpreted in favor of any particular User or National Obituary Registry. For the purpose or purposes of providing notice of termination, transfer of rights or cancellation of the Services, contact National Obituary Registry.
